Rules and Terms of Contest

• 1. Entering the Contest and Choosing and Contacting the Winner
• Entries will be judged entirely at the discretion of uSwapit.com. The winning entry will be the single submission judged most likely to succeed as a Power Swapper on uSwapit.com. Criteria will include, but not be limited to, aesthetic appeal, uniqueness, marketability, and feasibility of implementation.
• Entrants must be registered users of uSwapit.com and have correctly filled out the registration form to get entry.
• Multiple entries are permitted, based on the number of swaps, and other purchases made on uSwapit.com.
• Swap's, Verification, or Credit purchase for entry must be received before 12:00 AM EDT, July 30, 2008.
• The winner of the contest will be contacted at the email address used to register the account, and the person receiving and replying to the winner announcement email will be considered the winner unless they specify another person within the reply email as the winner. uSwapit.com will mail the contest prize to the address supplied by the recipient of the winner announcement email.
• Claiming of the prize requires an email response to uSwapit.com from the winning sender email address within 30 days of being notified of winning at the email address used to enter. Failure to respond shall mean that the winner forfeits the prize.
• 2. Swapping anything for anything, Getting Swap Verified and purchasing credits grants you entry into the contest.
• You understand and intend that any Swapping conducted can be available for viewing and comment on by the public, and understand that comments with which you disagree or are unhappy about may be published or otherwise become associated with any information you submit to uSwapit.com.
• You hereby agree to hold uSwapit.com and its affiliates, subsidiaries, licensees sponsors and assigns harmless from and against, and hereby waive any right to pursue, any claims of any nature arising in connection with the inclusion in, publication via or display on any uSwapit.com site under these Terms, of any information submitted to uSwapit.com by you;
• 3. Awarding of the Prize
• The winner will receive a 8 GB iPod Touch (approximate retail value $299). No cash or prize substitution, transfer or assignment by winner is allowed. uSwapit.com Software reserves the right to substitute a prize of equal or greater value if the prize or a portion of it becomes unavailable. Applicable taxes and any other expenses not specified here are the winner’s sole responsibility. The only prize being awarded is one iPod Touch. No additional or other prizes are being awarded.
• The prize winner must supply uSwapit.com with his/her legal name, mailing address, birth date, daytime and nighttime telephone numbers.
• Neither uSwapit.com, uSwapit.com sponsors, nor employees of uSwapit.com or sponsors may be held liable for any warranty, costs, damage, injury, or any other claims incurred as a result of usage of any winners of a prize once possession has been taken of the product by winner. uSwapit.com is not liable for any loss arising out of or in connection with or resulting from any contest promoted by uSwapit.com.
